Poison Face Copyright Lawsuit

Glam metal heroes Poison are being sued for copyright infringement. The suit comes from Billy McCarthy and James Stonich and dates all the way back to the '80s.

According to The Hollywood Reporter, the lawsuit was filed Oct. 19th in Illinois federal court.

McCarthy and Stonich were members of the now-defunct, Chicago-based band Kid Rocker. Their lawsuit alleges that some of their songs were incorporated into Poison tracks, including the famous singles 'Talk Dirty to Me' and 'I Won't Forget You.'

The suit also argues that Poison axe man C.C. DeVille auditioned for Kid Rocker in 1984 and given demo tapes of the band's work. The former Kid Rocker band mates are also suing executives at Capitol Records and EMI Music. McCarthy and Stonich want song profits, damages and even an injunction against Poison from performing the tracks.

'Talk Dirty to Me' and 'I Won't Forget You' are featured on Poison's debut record, 'Look What the Cat Dragged In' released by the Enigma, a Capitol Records-distributed label, in 1986.
